media.ithaca.edu and Sakai media tools - Service Terms of Use Guidelines
The purpose of this document is to establish appropriate guidelines for using the Ithaca College media service called media.ithaca.edu or the Sakai media tool. The guidelines in this document apply to the use of media.ithaca.edu that are produced as communication for or from Ithaca College by students faculty and staff and its colleges, divisions, departments, courses, organizations and other units. This document has been approved by Information Technology.
Service Description
Ithaca College has partnered with Kaltura to provide a video distribution service That allows any faculty, staff, or student to upload, manage, and deliver your video, image, and audio content. This service is easy to use and delivers high quality media to your students for a variety of educational uses.
As a user of the service, you must comply with all federal, state, local, and other applicable laws. You are also expected to comply with all Ithaca College policies. /policies/

Responsibility for Content/Content Ownership
Media content may be visible to participants within a course and others at the discretion of the content author. Uploaded content is made private by default. Each piece of content is associated with an individual's campus-provided credentials. This individual, hereafter known as the 'primary author', is responsible for the content and associated data uploaded to the Kaltura system.
Both individual and course content should reflect the positive and respectful learning and working environment of Ithaca College within which basic rules of conduct for the individual campus community, as well as the general Ithaca College community are followed. Such rules of conduct are articulated in the individual campus policies and guidelines for faculty, staff and students. /policies/
Eligibility and Content Expiration
Ithaca College faculty, staff, and students with current and active campus-authorized credentials (e.g. Netpass user ID) are eligible to access and use Kaltura. Users who leave the college will lose access to their media, but have the ability to download or transfer the content to another Ithaca College user before they leave. Ithaca College will attempt to keep content for as long as it is relevant, but since we cannot host all content indefinitely, due to a file size limitation, generally will have a 2 year expiration.
Since there are file size limitations to our campus system, you should know that this service is not necessarily intended to be an archive tool for all your media. This system is intended to be used as a media distribution and management tool. Please keep your original media files stored somewhere safe, such as on your personal computer, a CD/DVD, or other form of electronic storage. Do not rely on media.ithaca.edu as your only storage location.
Copyright
Publishing media content may involve incorporation of original works of third parties (e.g., photographs, music, film, and video works) that are covered by copyright laws. All channels and playlists in Kaltura have a specified primary author who is solely responsible for detailing the sharing and permissions pertaining to copyright, fair use, and/or creative common licensing for uploaded, shared, and hosted content within each item. Use of such works may be permitted by principles of fair use, consistent with copyright laws. Copyright permissions are necessary regarding original Ithaca College content as well. Any use of Ithaca College media content, or works derived from that content, should be attributed to the original faculty member, staff member, or student and Ithaca College.
FERPA
Faculty and staff should be aware that the content hosted by the Ithaca College Kaltura system identifying students, or content contributed by students, constitutes an educational record and that FERPA regulations apply. Those regulations require that the content be protected from disclosure without student consent. Disclosure in this context includes use outside of the class such as posting student content openly on the Internet. Faculty who intend to post original student work in such a manner may do so with the students’ permission or by providing an opt out option for individual students. Please be aware that when using the media service for non-academic purposes, the owner of the media you view or viewers of media that you have made public or semi-public may be able to see your name and netId.

The media content served by the service does not in any way constitute official Ithaca College content. The views and opinions expressed in the content are strictly those of the primary authors. The media content have not been reviewed or approved by Ithaca College. Ithaca College makes no representations or warranties of any kind, express or implied, as to the content hosted by this service. Ithaca College will not be liable for any damages of any kind arising from the use of or inability to use the media content hosted by this service. Questions or concerns about the media content should be directed to the primary content author.
Non-Commercial Use
The Ithaca College media system provides access primarily for instructional purposes. You may not sell, profit from, or commercialize from the Ithaca College media system.
Monitoring
Ithaca College does not routinely pre-screen, monitor, or regularly review posted content and associated data, yet reserves the right to remove, at any time, at its sole discretion, any content that it considers to violate these Terms of Use or the provisions of any other campus policies that may govern use of the campus system, or that it deems in violation of Ithaca College policy, or local, state, or federal law.
Should Ithaca College receive reports that inappropriate content has been posted, Ithaca College will notify the designated campus Kaltura Administrator to contact the primary author to initially discuss the issue. In exceptional cases, where the content is unacceptable, Ithaca College administrators will immediately remove the entry, prior to contacting the primary author. Unacceptable entries of this sort also may cause a revocation of the individual’s access to the service, and in extreme cases, may result in disciplinary proceedings against the primary author and/or contributing authors.
Ithaca College collects certain non-personally identifiable information to evaluate the manner in which the system is used in order to improve the service. This may include other web analysis data to measure and analyze usage. This information may be shared with college stakeholders in summary.
Service Availability
The service is provided as a hosted service by the vendor (Kaltura). Planned maintenance outage will be communicated in advance. Unplanned outages will be worked on immediately. If the outage lasts longer than a few hours we will communicate through appropriate communications channels.
